Terms of Service

These Terms of Service ("Terms") govern access to and use of the websites, web hosting, free/ paid design and development packages, SEO tools, file converters, AI tools, and related services (the "Services") offered by ClouHost ("we", "us", "our"). By using the Services you agree to these Terms.

1. Eligibility & accounts

• You must be legally able to enter a binding contract in your jurisdiction.
• You are responsible for keeping login credentials confidential and for activity under your account.
• Provide accurate registration information and keep it updated.
• We may suspend or terminate accounts that violate these Terms or pose a security risk.

2. Services overview

ClouHost provides web hosting and related digital services. Where advertised, web design and/or development may be included free or discounted with qualifying hosting plans, subject to fair-use scope described at order time. We do not sell domain names as a primary product unless explicitly stated; you may use domains you already own or register elsewhere.

3. Plans, billing & renewals

• Fees, currency, discounts, and billing cycles are shown at checkout or in your invoice.
• Unless stated otherwise, plans renew automatically for the same term until cancelled.
• Promotional pricing may apply only to the first term; renewals may be at standard rates.
• Failure to pay may result in suspension or deletion of hosting data after notice where required.

4. Money-back / refunds

If we advertise a money-back guarantee (e.g. 30 days), it applies only to hosting fees as described in the offer and excludes third-party costs, domains, add-ons, and completed custom design/development work already delivered. Statutory consumer rights (where applicable) are not affected.

5. Acceptable use

You must not use the Services to:

• Host or distribute malware, phishing, spam, or illegal content
• Infringe intellectual property, privacy, or publicity rights
• Mine cryptocurrency without written approval
• Attack, probe, or overload systems (including ours or third parties)
• Store or process unlawful special-category data without lawful basis
• Resell hosting as a white-label unless your plan expressly allows it

We may remove content or suspend service to protect the platform, other customers, or comply with law.

6. Customer content & backups

• You retain ownership of your content. You grant us a limited license to host, backup, and process it solely to provide the Services.
• You are responsible for maintaining independent backups of critical data. We may offer snapshots/backups as a convenience, not as a guarantee of recovery.
• Upon termination, we may delete data after a grace period unless law requires retention.

7. Design & development (including "free" packages)

• Scope, revisions, timelines, and deliverables are defined in the order or project brief.
• Fair-use limits apply to free design/development offers (page count, features, stock assets, turnaround).
• Out-of-scope work may be quoted separately.
• Unless agreed in writing, we may showcase non-confidential work in our portfolio.
• Third-party licenses (themes, plugins, fonts, images) remain subject to their own terms; you are responsible for ongoing license fees after delivery unless included.

8. Free tools (SEO, converters, AI)

Free tools are provided "as is" for convenience. Output accuracy is not guaranteed. Do not upload confidential data to tools unless you accept residual processing risk. Rate limits and fair use apply. We may change or discontinue free tools without liability.

8A. AI Detector & AI Text Humanizer

The free AI content detector and humanizer (including ClouHostAi at /ai-detector/) are part of the Services and are governed by these Terms plus the following:

• Client-side processing: Detection and humanization are designed to run in your browser. Text you paste or upload is not intended to be transmitted to our servers for analysis.
• Informational only: AI likelihood scores, heatmaps, and metrics are probabilistic estimates — not definitive proof. They must not be the sole basis for academic sanctions, employment decisions, legal action, or publication rejection.
• Humanizer disclaimer: Rewritten text may alter meaning or contain errors. Humanization does not guarantee that text will pass any third-party detector or comply with institutional policies — you are responsible for how you use outputs.
• Acceptable use: Do not use the tools for fraud, harassment, academic dishonesty, or to circumvent lawful platform rules. Do not overload, scrape, or reverse-engineer protected engines.
• No professional advice: Results are editorial/informational only, not legal, academic, medical, or financial advice.
• Eligibility: You must meet the minimum age required in your jurisdiction (and parental consent where required) to use free tools without an account.

9. Service levels & support

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and force majeure events may cause downtime. Support channels and hours are described on the website.

10. Intellectual property

Our branding, software, UI, documentation, and non-customer materials are owned by ClouHost or licensors. You may not copy, reverse engineer, or resell them except as allowed by law or written license.

11. Privacy

Personal data is handled according to our Privacy Policy and cookie controls. By using the Services you acknowledge that processing.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that tools will meet your commercial outcomes or that hosting will be error-free.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ClouHost SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/DATA/GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

14. Indemnity

You agree to indemnify and hold harmless ClouHost from claims arising out of your content, your use of the Services, or your violation of these Terms or applicable law.

15. Suspension & termination

You may cancel per your plan's terms. We may suspend or terminate for non-payment, AUP violations, legal risk, or extended inactivity. Provisions that by nature should survive (IP, liability, indemnity) will survive termination.

16. Changes to Terms

We may update these Terms. Continued use after the effective date constitutes acceptance of the revised Terms, except where mandatory law requires explicit consent.

17. Governing law

These Terms are governed by the laws applicable to our principal place of business, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts of competent jurisdiction there shall have exclusive venue, subject to consumer rights to local courts where non-waivable.
